Acquisition of Temporary Residence Visas

The Immigration Act 13 of 2002 provides for foreigners to acquire a permanent residence permit (subject to the fulfilment of certain requirements) wherein such a foreigner is guaranteed the rights and obligations of a citizen of The Republic of South Africa. 

SCRA Reviews and Appeals

If an applicant holds substantial grounds for an asylum permit, the applicant shall be granted asylum by the Refugee Status Determination Officer (RSDO), under section 24(3)(a) of the Refugees Act. However, if such an application is denied, the applicant has the right to appeal to the Standing Committee on Refugee Affairs (SCRA), the decision of the RSDO, within 14 days. If the SCRA upholds the decision of the RSDO, the next step will be to apply for leave to appeal to the High Court.
