Temporary residence visas are set out in sections 10 to 23 of the Immigration Act, 13 of 2002, as amended, to allow a foreigner the opportunity to enter South Africa and conduct activities in line with the specific temporary residence visa applied for ranging from tourist, study, general work, voluntary work visa, critical skills, retirement, spousal, business.

All temporary residence visa applications must comply with the requirements of the Immiration Act 13 of 2002 as amended as well as the Regulations to the Immigration Act. Temporary residence visas may be renewed at least 90 days before the expiry of the relevant visa. A visa issued for 90 days must be renewed at least 30 days before its expiry and if the visa was issued for 30 days such visa must be renewed at least 7 days before its expiry date. Visa holders should not allow visas to expire or overstay in the counrty which will lead to such visa holder becoming illegal in the RSA.In such a case such visa holder will have to apply for authorisation to remain in the counrty (Form 20) before an expired visa could be renewed.
